Engagement Rules

Terms of Service.

These Terms of Service govern your engagement with Tech Shark Solution. By accessing our platform or commissioning our services, you agree to these professional engineering standards.

1. Service Engagement

Tech Shark Solution provides high-performance digital engineering services, including but not limited to:

Specific project deliverables, timelines, and costs are governed by individual Statements of Work (SOW) which incorporate these terms by reference.

2. Intellectual Property Rights

2.1 Client Ownership

Upon full payment of all fees, the custom code, designs, and technical assets specifically developed for the Client shall be considered "Work Made for Hire," and ownership shall vest with the Client.

2.2 Tech Shark "SaaS-Core" & Libraries

Tech Shark Solution retains ownership of its proprietary pre-built libraries, "SaaS-Core" modules, and development methodologies used to accelerate builds. Clients are granted a non-exclusive, perpetual, royalty-free license to use these modules as integrated within their custom solution.

Invoices are issued according to the milestones defined in the SOW. Payments are due within 14 days of invoice issuance. Tech Shark Solution reserves the right to suspend development or hosting services for accounts with overdue balances exceeding 30 days.

5. Limitation of Liability

Consistent with professional engineering standards, Tech Shark Solution’s liability for any claim arising from our services is limited to the total amount paid by the Client for the specific project or phase giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of revenue or data.

6. Warranties and Maintenance

We provide a 90-day "Hyper-Care" warranty period post-launch to address any technical bugs or performance regressions within the original scope. Ongoing maintenance and security updates beyond this period require a separate Support Service Agreement.

7. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which Tech Shark Solution is registered. Any disputes shall be resolved through binding arbitration before seeking judicial intervention.
